Conditions table
# Condition Details
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(3) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(4) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(5) The Sewage Treatment Works are close to noise sensitive residential dwellings. Work on site should only take place between the hours of 08.00 and 18.00 Monday to Friday and 08.00 to 13.00 Saturdays. No work should take place on Sundays and Bank Holidays. REASON: In the interests of the amenities of the area.
(6) During construction no burning of waste material should take place on site. REASON: In the interests of the amenities of the area.
(7) INFORMATIVE: As there is some potential for noise disturbance during the upgrading of the works, I would request that the applicant consults with the Environmental Protection Section regarding any activities which are likely to give rise to noise (or odour) disturbance, and in particular that the Environmental Protection Section is given prior warning of times and likely duration of any pile driving activities during the development.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and SER3 were relevant to this decision.
REASON FOR DECISION: The proposal is to upgrade existing plant and buildings at Marske Sewage Treatment Works which are nearing the end of their life. The development is within the operational site. The works would be partially screened by the existing bund. The new plant would be linked to the existing odour treatment system. Since the proposal is an upgrade of the existing plant it is not considered that there will be an adverse effect of the amenity of the area or raise issues of highway safety or crime prevention. The proposal accords with the adopted Local Plan.
