# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) The elevation of the cycle-way will be no higher than the existing ground level. REASON: To ensure there is no significant loss of floodplain storage.
3 (3) Prior to the commencement of development, a maintenance programme or hydraulic design shall be submitted to and agreed in writing by the Local Planning Authority. This shall include simple modeling to establish flood levels before and after the construction of the new culvert and should detail how siltation of the culvert is to be prevented and the Cross-Sectional-Area (CSA) of the culvert maintained. REASON: It is proposed that the invert of the new culvert is to be marginally below the existing bed levels. There is a danger that this lowered bed would become silted up, reducing the cross-sectional area (CSA) of the culvert.
4 (4) Prior to the commencement of development, a scheme showing how surface water run-off from the proposed cycle-way will be limited to the existing rate, shall be submitted to, and agreed in writing by the Local Planning Authority. REASON: To ensure the proposed development will not exacerbate flooding elsewhere.
5 NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and T15 were relevant to this decision.
6 REASON FOR DECISION: It is considered that the proposed development will not cause significant harm to the amenities of local residents or adversely affect the character and appearance of the area. The application does not raise any issues in respect of crime prevention or highway safety. The proposal accords with the Council's Local Plan.
