| # | Condition Details |
|---|---|
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The external elevations of the extension shall be constructed in materials to match those of the existing building. REASON: In the interests of the appearance of the development in the locality.
(3) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(4) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(5) Prior to the occupation of the dwelling hereby approved details of the boundary walls and fences shall be submitted for approval in writing by the Local Planning Authority. The approved scheme shall be completed in its entirety and shall thereafter be maintained. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
INFORMATIVE: The developer should be aware that the shared drive should be a minimum of 4.1 metres wide or passing places provided.
INFORMATIVE: The developer should note that kerbside refuse collections are in operation.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, H3, H4 & T6 were relevant to this decision.
REASON FOR DECISION: The proposal represents an amendment to a previously refused proposal. There are no boundaries marked on site. There is an existing dwelling to the east side of the application plot and this plot will share the access to Dam Street. A third dwelling is located to the west and this has an access from Hall Grounds. The land is not flat and there is a steeply rising slope to Hall Grounds. In this context it is considered that the proposal would not have a deleterious affect upon the character and appearance of the area. The characteristics of this site and the proposed layout is such that the development would not result in a material impact upon the living conditions of adjacent occupiers to warrant a recommendation that planning permission be refused. The site provides sufficient vehicle parking and shares an access from Dam Street. No harm to highway safety is envisaged. This proposed dwelling would be no more vulnerable to crime than its neighbours
