|---|---|
(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(3) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(4) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(5) Details of boundary walls / fences shall be submitted for approval in writing and the approved scheme implemented prior to the first occupation of any dwelling at the site and thereafter be maintained. REASON: In the interests of visual and residential amenity.
INFORMATIVE NOTE: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
INFORMATIVE NOTE: The land currently accommodates telegraph and other poles. These may need to be repositioned prior to development being undertaken.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, H3 & T6 were relevant to this decision.
REASON FOR DECISION: The surrounding area comprises a mix of dwelling types. The site is adjacent to terraced dwellings. The changes in ground level have been noted; the land slopes from front to rear. Despite these changes the development would to some extent replicate the circumstances relating to the terraced block to the east. No harm to the character or appearance of the area is envisaged. With regard to the impact upon residential amenity, the development would be in close proximity to the dwellings to the north that run perpendicular to this site. The opportunities for loss of privacy by way of overlooking are therefore reduced .The design has sought to further reduce those opportunities. It is noted that no objections have been received from those in close proximity to the site. It is clear that the terrace to the east has assimilated into the street without detriment to residential amenity. This development should therefore similarly be readily assimilated into the street without detriment to residential amenity. With regard to highways taking into account the sites location it is considered that one car parking space per dwelling is acceptable. This proposal due to the general configuration of the existing built environment and road/access layout could not achieve interlocking gardens. The proposed properties would be no more vulnerable to crime than the existing dwellings.
