Conditions table
# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) This permission relates only to the amended plan(s) received by the Local Planning Authority on 13 December 2005. REASON: For the avoidance of doubt.
3 (3) The first floor window in the west elevation of the development, and any subsequent replacement, shall be glazed throughout with obscure glass and thereafter retained to the satisfaction of the Local Planning Authority. REASON: To safeguard the living conditions of the occupants of adjacent residential properties.
4 NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision.
5 REASON FOR DECISION: The proposed extension would complement the appearance of the existing dwelling and a gap would be maintained between it and the neighbouring extension. It would not therefore prejudice the aims of Local Plan Policy to protect the character and appearance of the area. The existing dwelling is in close proximity to its neighbours to the west; the two-storey element would be immediately to the rear of 18 Marlborough Road. 18 Marlborough Road has a first floor extension at the rear at its northern extremity and an extension at ground floor that extends to within approximately a metre of the boundary with the application property. Similarly, 16 Marlborough Road has a single storey extension that is also close to the boundary with the application property. The outlook from the adjacent dwellings is already compromised. Following further internal consultation the view has been formed that the additional impacts resulting from the proposed development would be insufficient to warrant refusal in this case. In all other respects the application is acceptable. The site would continue to maintain a garage space and drive and thus the proposal would not prejudice highway safety. The application does not compromise the aims of the Local Plan with regard to crime prevention.
