Conditions table
# Condition Details
1 (1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 1995, (or any Order revoking or re-enacting that Order) no enlargement of the dwelling(s) or development within the curtilage the subject of this permission shall be carried out without the express consent of the Local Planning Authority. REASON: To safeguard the character and appearance of the development.
3 (3) No boundary walls/fences shall be erected at the site without the prior written approval of the Local Planning Authority. REASON: In the interests of visual amenity.
4 (4) No domestic paraphernalia including the installation of washing lines shall be installed/erected within the curtilage of the dwellings hereby approved unless first agreed in writing with the Local Planning Authority. REASON: In the interests of visual amenity.
5 (5) Notwithstanding the details provided on the submitted plans and elevations, approval of the exact details of the design, materials and external appearance of the roof lights shall be obtained from the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
6 NOTE: Redcar and Cleveland Local Plan Policies GEN1 & GEN2 were relevant to this decision.
7 REASON FOR DECISION: Permission is sought for the installation of roof lights at No 2 Skelton Cemetery, Stanghow Road, Skelton. The property is a disused chapel located within the entrance to Skelton Cemetery. The property already has permission for conversion into residential. It is considered that policies Gen 1 and Gen 2 of the Local Plan provide the basis for determining the proposal. These policies seek to achieve development that respects the character and appearance of the area; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The roof lights would be located in the northern and eastern roof planes of the property situated approximately half way up the roof and spaced evenly along the width of the roof planes. The primary purpose of the roof lights is to enable the use of the roof space as living accommodation, with the upper floor accommodating 3 bedrooms, a bathroom and an en-suite. The building is neither a statutorily listed building nor is it located within a conservation area. Therefore, it is considered that the design is considered acceptable in principle, subject to the specification of the roof lights, which should complement the materials used in the existing building. Concern has been raised from a Ward Councillor in regards to overlooking created from the roof lights. The roof lights (4 No) in the northern elevation front onto the adjacent lodge and the roof lights (4 No) in the southern elevation will front onto an existing oak tree. It is acknowledged that the occupants will be able to look out on to the cemetery at times, but it is not considered that this would be to an extent that it would be detrimental to the area or intrude on the privacy of visitors to the cemetery. Concern has also been raised in regards to a possible increase in cars at the property. The application that was previously approved for conversion of the chapel into a dwelling provided 2 parking spaces within the curtilage of the property. These spaces would still be available as part of this application and therefore satisfy the minimum amount required for a residential dwelling. The previously approved application had conditions attached removing permitted development rights for extensions/enlargement of the property. The conditions also required details to be submitted of any walls/fences being erected, the provision of domestic paraphernalia or the installation of washing lines. Therefore, if consent were to be granted, the relevant conditions would be applied. The application does not raise concerns regarding highway safety or crime prevention.
