(1) The development shall not be begun later than the expiration of THREE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) No development approved by this permission shall be commenced until:- (a) The application site has been subjected to a detailed scheme for the investigation and recording of contamination including soil contamination, ground/surface water contamination, landfill gas, leachates and stability as appropriate; (b) Detailed proposals for the removal, containment or otherwise rendering harmless any contamination (the 'Reclamation Method Statement') have been determined through risk assessment and approved in writing by the Local Planning Authority; (c) The works specified in the Reclamation Method Statement have been completed in accordance with the approved scheme; Any contamination not considered in the Reclamation Method Statement but identified during the reclamation works should be subject to further risk assessment and remediation proposals agreed with the Local Planning Authority. A report demonstrating that the works were carried out in accordance with the approved scheme (the 'Validation Report') should be submitted to the Local Planning Authority within 2 months of completion of the development. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection.
(3) The highway work shall be designed in accordance with the Council's design standards for roads serving residential development and shall be carried out in accordance with the Council's standard specification for road, sewer and street lighting works serving private developments in order to secure adoption and the details to be submitted to the Director of Development at least one month before the commencement of the works, and the works carried out to the satisfaction of the Local Planning Authority before any of the dwellings are occupied. REASON: In the interest of the visual amenities in the locality.
(4) No development shall take place and no trees / hedges shall be reomved until there has been submitted to and agreed in writing by the Local Planning Authority a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land and details of those to be retained together with measures for their protection in the course of the development. REASONS: In the interests of the visual amenities in the locality.
(5) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(6) Notwithstanding the provisions of the Town and Country Planning General Development Order, 1988 (or any Order revoking or re-enacting that Order), no fences, gates, or walls shall be erected within the curtilage of any dwellinghouse forward of any walls of that dwellinghouse which front onto a road. REASON: To safeguard the character and appearance of the development.
(7) The trees, hedges and undergrowth on the quarry face shall not be removed unless the prior consent of the Local Planning Authority has been obtained. REASON: In order to maintain the stability of the quarry faces.
(8) The first floor windows within the northwest elevation shall be obscure glazed and maintained for the lifetime of the development. REASON: In the interests of residential amenity.
(9) This permission relates only to the amended plan(s) received by the Local Planning Authority on 18 November 2005. REASON: For the avoidance of doubt.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1, H1. H2 and T6 were relevant to this decision.
REASON FOR DECISION: The desire of the applicant to achieve a 'stand alone' residential scheme that creates a unique form of development for Boosbeck is to be encouraged. The site would only be viewed obliquely from the High Street. Due to the siting and juxtaposition with the existing built environment no harm to the general character or appearance of the area. It is considered that the proposal would respect residential amenity and be acceptable from a highway point of view. This isolated dwelling may be vunerable to crime, however, as part of the overall scheme it should be no more vulnerable than others in the locality.
