# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The development shall only be built in accordance with revised plans submitted on 25 August 2005 subject to an amended layout that shows the omission of the 'vision mirror' and parking/access provision adjacent to House 2. REASON: For the avoidance of doubt and in the interests of highway safety.
(3) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(4) The wall between this site and the existing Kindom Hall shall be 'cut back' and the footpath constructed prior to the first occupation of any of the dwellings hereby approved. REASON: In the interests of highway safety.
(5) The first floor window in the east elevation of the development, and any subsequent replacement, shall be glazed throughout with obscure glass and thereafter retained to the satisfaction of the Local Planning Authority. REASON: To safeguard the living conditions of the occupants of adjacent residential properties.
(6) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 1995, (or any Order revoking or re-enacting that Order) no enlargement of the dwelling(s) the subject of this permission shall be carried out without the express consent of the Local Planning Authority. REASON: To safeguard the character and appearance of the development.
(7) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(8) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1 and H3 were relevant to this decision.
REASON FOR DECISION: The site is within the limits to development as set out in the Council's Local Plan. The layout and design are acceptable and accords with the guidance set out in the Local Plan. The development respects the amenity and character of the area. The application does not raise any issues in respect of crime prevention or highway safety. The proposal therefore accords with the Council's Local Plan.
