| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) A suitable window display shall be incorporated into the frontage of the premises and thereafter maintained to the satisfaction of the Local Planning Authority. REASON: In the interests of the amenities of the locality. |
| 3 | REASON FOR DECISION: The application as originally submitted was for a change of use from Class A1 into Class A2. However, it was considered that the proposed use, which is already in operation, was actually a Class B1 use. As such it was requested that the application be amended to a change of use from Class A1 into B1. Therefore, the proposed scheme is for a change of use from Class Use Class A1 into B1. The property is within the boundary of a local shopping centre as identified in the Redcar and Cleveland Local Plan (1999). Policy SH2 of the Local Plan only permits A1, A2, A3 and D1 uses in local shopping centres as these are considered to provide a useful local service. However, in consideration of the existing uses within the local shopping centre, it is considered that a B1 use would be considered acceptable if it were to incorporate a suitable window display, which would alleviate the problem of creating a dead frontage, which could reduce the visual appearance of the centre. |
| 4 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, SH2 and SH6 were relevant to this decision. |
