| 8 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, H3 and T6 were relevant to this decision. |
| 9 | REASON FOR DECISION: Permission is sought for development comprising a detached house with an attached garage on land to the east of 12 Normanby Hall Park, Normanby. The site currently forms part of the private garden of that dwelling. In determining the proposal the provisions of the Local Plan and in particular Policies GEN1, GEN2, H3 and T6 must be taken into account. These policies seek to achieve development that respects the character and appearance of the area, that respects residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. Normanby Hall Park comprises detached two storey dwellings located on variously sized plots. The resulting plot sizes following subdivision would compare favourably with others nearby. The simple design of the proposed dwelling would reflect the elements of the design of nearby dwellings and its position is such that it would not compromise the overall appearance of the area. The Councils Arborist and Woodland Officer advises that this proposal would not have a significant impact upon the trees. Due to the design, layout and location of the development it is not considered that it would have a detrimental impact upon the living conditions of adjacent residential occupiers. The design indicates obscure glazed windows at first floor serving a dressing room an en-suite and a window serving a void over the entrance hall and this may also be obscure to negate any feelings of being overlooked. The proposed access would run from a point south west of the dwelling at 11 Normanby Hall Park and then parallel with the southern boundary of that dwelling at its closest the drive would be a little over 3 metres from the dwelling. The activity associated with access to a single dwelling at this site would not be so great as to warrant a recommendation for refusal on amenity grounds. The proposed dwelling would be no more vulnerable to crime than others in the locality and would not therefore compromise the crime prevention aims of the Local Plan. The proposed access arrangements at a point to the south west of 11 Normanby Hall Park have been found to be satisfactory in highway terms. The provisions of covenants are not a matter for the Local Planning Authority to resolve. |
