(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) No development approved by this permission shall be commenced until: (a) a desk top study has been carried out which shall include the identification of previous site uses, potential contaminants that might reasonbly be expected given those uses and other relevant information. And using this information a diagrammatical representation (Conceptual Model of the geology and hydrogeology) for the site of all potential contaminant sources, pathways and receptors has been produced. (b) A site investigation has been designed for the site using the information obtained from the desk top study and any diagrammatical representations (Conceptual Model of the geology and hydrogeology). This should be submitted to, and approved in writing by the LPA prior to that investigation being carried out on the site. The investigation must be comprehensive enough to enable: - a risk assessment to be undetaken relating to ground and surface waters associated on and off the site that may be affected, and - refinement of the Conceptual Model, and - the development of a Method Statement detailing the remediation requirements. (c) The site investigation has been undertaken in accordance with details approved by the Local Planning Authority and a risk assessment has been undertaken. (d) A Method Statement detailing the remediation requirements, including measures to minimise the impact on ground and surface waters, using the information obtained from the Site Investigation has been submitted to the Local Planning Authority. This should be approved in writing by the Local Planning Authority prior to that remediation being carried out on the site. REASON: To protect Controlled Waters and ensure that the remediated site is reclaimed to an appropriate standard. (e) Upon completion of the remediation detailed in the Method Statement a report shall be submitted to the Local Planning Authority that provides verification that the required works regarding contamination have been carried out in accordance with the approved Method Statement(s). Post remediation sampling and monitoring results shall be included in the report to demonstrate that the required remediation has been fully met. Future monitoring proposals and reporting shall also be detailed in the report. REASON: To protect Controlled Waters by ensuring that the remediated site has been reclaimed to an appropriate standard.
(3) Development approved by this permission shall not be commenced unless the method for piling foundations has been submitted to and approved in writing by the Local Planning Authority. The piling shall thereafter be undertaken only in accordance with the approved details. REASON: The site is contaminated/potentially contaminated and piling could lead to the contamination of groundwater in the underlying aquifer.
(4) If during development, contamination not previously identified, is found to be present at the site then no further development (unless otherwise agreed in writing by the Local Planning Authority) shall be carried out until the applicant has submitted, and obtained written approval from the Local Planning Authority for, an addendum to the Method Statement. This addendum must detail how this unsuspected contamination shall be dealt with. REASON: To ensure that the development complies with the approved details in the interests of protection of Controlled Waters.
(5) Details of additional landscaping schemes shall be agreed with the Local Planning Authority. The submitted details shall also include details of the planting for the site margins and any mounding. REASON: To ensure a satisfactory form of development.
(6) Construction work shall take place between 07:00 - 19:00 hours (Monday - Friday) and 08:00 - 13:00 hours on Saturdays unless otherwise agreed with the Local Planning Authority. REASON: In the interests of the amenities of the area.
(7) Wheel washing facilities shall be provided at all times during the construction period to the satisfaction of the Local Planning Authority. REASON: To ensure a satisfactory form of development.
(8) Details of a scheme for the provision / improvement of cycling facilities shall be submitted and agreed with the Local Planning Authority and thereafter implemented to the satisfaction of the Local Planning Authority. REASON: To ensure a satisfactory form of development.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and IND1 were relevant to this decision.
REASON FOR DECISION: The application site is within the Wilton complex which is identified in the Council's Local Plan as a site for potentially polluting or hazardous industrial development (Policy IND1). The new plant will be viewed against the backdrop of the existing plant on the Wilton site. Whilst it is accepted that noise from non-routine flaring/venting will be above background levels, given the short duration of these events, the impact is considered acceptable. Additionally, emissions should not exceed acceptable levels. The proposal wil generate additional employment and help underpin Huntsman operations on Teesside. There were no highway objections to the proposal.
