| # | Condition Details |
|---|---|
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(3) This permission relates only to the amended plan(s) received by the Local Planning Authority on 15 September 2005. REASON: For the avoidance of doubt.
(4) Details of materials to be used for all hard surfaces shall be submitted to and agreed in writing by the Local Planning Authority prior to the commencement of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(5) Full details of the boundary walls/fences and the repair of the retaining wall shall be submitted for approval in writing by the Local Planning Authority prior to the commencement of development on site. The approved details shall be implemented in their entirety and thereafter be retained. REASON: In the interests of visual and residential amenity.
(6) No development approved by this permission shall be commenced until:- (a) The application site has been subjected to a detailed scheme for the investigation and recording of contamination including soil contamination, ground/surface water contamination, landfill gas, leachates and stability as appropriate; (b) Detailed proposals for the removal, containment or otherwise rendering harmless any contamination (the 'Reclamation Method Statement') have been determined through risk assessment and approved in writing by the Local Planning Authority; (c) The works specified in the Reclamation Method Statement have been completed in accordance with the approved scheme; Any contamination not considered in the Reclamation Method Statement but identified during the reclamation works should be subject to further risk assessment and remediation proposals agreed with the Local Planning Authority. A report demonstrating that the works were carried out in accordance with the approved scheme (the 'Validation Report') should be submitted to the Local Planning Authority within 2 months of completion of the development. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection.
(7) The dwelling hereby approved shall not be occupied until the vehicle parking and access has been provided. REASON: In the interests of highway safety.
REASON FOR DECISION: Permission is sought for two dwellings on land that currently accommodates a slaughterhouse located at the rear of 120 High Street, Skelton. The submitted plans indicate that a pair of dwellings would be sited towards the rear (8) of the site with a parking area and access proposed from the east. The site constitutes previously developed land and this development would be achieved by providing minimal amenity area. The site is, however, adjacent to an open area of land that is outside the limits of development. This will aid the assimilation of the development into the surroundings. No harm to the character or appearance of the Conservation Area is envisaged. The siting and location of the proposed development is such that no harm to the living conditions of nearby residential occupiers would result. The proposed development has been modified to achieve satisfactory access and parking. The finally revised layout is acceptable in highway terms. The proposed development would be no more vulnerable to crime than existing nearby property.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1, H3, ENV1 and ENV10 were relevant to this decision.
