(5) This permission relates only to the amended plan(s) received by the Local Planning Authority on 3 August 2005. REASON: For the avoidance of doubt.
(6) Prior to the commencement of the development, details of the methods to be used to protect the existing trees on the site from construction work shall be submitted to and approved in writing by the Local Planning Authority, and such measures as approved shall be carried out before the development commences and maintained throughout the period of construction until the completion of the development. REASON: To ensure that existing trees/hedges on and adjacent to the site which are to be retained, are protected from vehicles and works involved in the construction of the development.
(7) Notwithstanding the arboricultural consutants’ report dated 31 May 2005 submitted with the application, no trees shall be removed unless the prior consent of the local planning authority has been obtained. REASON: In the interests of the amenities of the area.
(8) A scheme for additional tree planting and landscaping shall be submitted to and agreed in writing by the local planning authority before development commences and thereafter implemented in accordance with the agreed scheme within the first planting season following completion of the dwelling. REASON: In the interests of the amenities of the area.
(9) The existing unauthorised fence along the southern boundary of the application site shall be removed prior to the first occupation of the dwellinghouse hereby permitted, and details of any walls, fences or other means of enclosure shall be submitted to and agreed in writing by the local planning authority prior to the development commencing. REASON: To protect the setting of the adjoining listed building and to reserve the rights of the local planning authority with regard to this matter.
(10) Prior to development commencing details of the proposed means of disposal of surface water shall be submitted to and agreed in writing by the local planning authority. REASON: To ensure a satisfactory form of development.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, ENV4 and ENV10 were relevant to this decision.
REASON FOR DECISION: A revised scheme has beeen negotiated which has reduced the size of the proposed dwelling to more-or-less the size of that previously approved on the site, but with the addition of a low ‘garden room/conservatory’, following the slope of the land. The first floor window which would have overlooked Craig House has been deleted and replaced with an obscurely glaze roof light to the bathroom. Despite the original tree report and proposals for significant felling of trees, particularly towards the valley, the applicant has accepted that a much lesser scheme of arboricultural works will be undertaken. This is to be covered by a condition requiring such a scheme to be agreed prior to commencement of work. The materials indicated for use in the construction of the house are appropriate to the area, subject to samples being submitted and approved. Only one objection has been received in relation to the amended scheme, reiterating previous concerns. It is not, however, considered that the dwelling now proposed is unacceptable in its relationship to the listed building, or that there will be any significant loss of privacy or residential amenity for the objector’s property. It is considered that on the basis of causing no harm, the proposal preserves the character of the conservation area and does not adversely affect the setting of the listed building. The site is within the limits to development set out in the Redcar & Cleveland Local Plan. The layout and design are acceptable and accord with the guidance set out in the Local Plan. The erection of the proposed dwelling does not raise any issues in respect of crime prevention or highway safety.
