# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) This permission relates only to the plans received by the Local Planning Authority on 26 May 2005. REASON: For the avoidance of doubt.
(3) Noise levels should not exceed 24db at a distance of 1 metre from the refrigeration and air conditioner units hereby approved. REASON: To safeguard the amenity of adjacent residential occupiers.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and ENV20 were relevant to this decision.
REASON FOR DECISION: The proposed development is considered to be appropriate within this existing commercial centre. It would not have an adverse impact on the character and amenity of the area. The application does not raise any issues in respect of crime prevention or adversely affect highway safety. The proposal accords with the Council's adopted Local Plan.
ADVISORY NOTE: In relation to the air conditioning units consideration should be given as to whether the air conditioning units need to be protected against damage from vehicles accessing and egressing the rear yard. In addition consideration should be given at this stage as to how air conditioning engineers could safely gain access to the unit for planned preventative maintenance. In particular consideration should be given to how the engineer reaches the unit and how the engineer is safely segregated from vehicles entering and existing the yard.
