# Condition Details
1 (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
3 (3) This permission relates only to the amended plan(s) received by the Local Planning Authority on 16 May 2005. REASON: For the avoidance of doubt.
4 (4) No part of the site shall be used for external storage without the prior approval in writing of the Local Planning Authority. REASON: In the interests of the visual amenities of the locality.
5 (5) The premises shall be closed and vacated before 0800 hours and after 1800 hours on weekdays, before 0800 hours and after 1300 hours on Saturdays and closed at all times on Sundays and Bank Holidays. REASON: In the interests of the amenities of the occupants of the residential properties in the locality.
6 (6) During construction works, there may be a potential risk of complaints regarding noise from site operations, and vehicles accessing the site. Work on site should only take place between the hours of 0800 and 1800 Monday to Friday, 0800 and 1300 Saturdays. No work should take place on Sundays or Bank Holidays. REASON: To preserve the amenity of the area.
7 (7) No burning of waste material should take place on site. REASON: To preserve the amenity of the area.
8 (8) Due to the potential for odour complaints, no paint spraying shall be carried out except in a properly constructed part of the workshop to which suitable filtration equipment has been fitted to the satisfaction of the Local Planning Authority. REASON: To preserve the amenity of the area.
9 (9) Details of any extract ventilation or fume extraction system, including the position of ventilation, fume or flue outlet points and the type of filtration or other fume treatment, to be installed and used in the premises in pursuance of this permission shall be first approved by the Local Planning Authority and installed before the development hereby permitted commences and thereafter retained in full accordance with the approved details. REASON: To preserve the amenity of the area.
10 (10) Any parts of the process which may generate significant amounts of dust shall be fitted with adequate dust suppression equipment. REASON: To preserve the amenity of the area.
11 Informative Note: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
12 Advisory Note: If the process has an annual turnover of 0.5 tonne of volatile organic compounds (11), or more, then it will also require a permit to operate, in accordance with the Intergrated Pollution Prevention and Control Regulations 2000 (please refer to Bob Cowell, Principal Environmental Protection Officer on 01287 612429 for further advice or information.)
13 NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision.
14 REASON FOR DECISION: The site is within an area identified for industrial/warehousing purposes. The design and siting of the development takes account of the principles set out in the supplementary guidance in the Local Plan. The proposal therefore accords with the Council's adopted Local Plan.
