Conditions table
# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) This permission relates only to the amended plan(s) received by the Local Planning Authority on 15 July 2005. REASON: For the avoidance of doubt.
(3) The external materials shall be as indicated on the submitted drawings. REASON: For the avoidance of doubt.
(4) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(5) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(6) Revised porch details shall be submitted for approval in writing by the Local Planning Authority prior to the commencement of development. The submitted drawings should indicate no encroachment of the access. The revised details shall be adhered to. REASON: To achieve an unobstructed access.
(7) No development approved by this permission shall be commenced until:- (a) The application site has been subjected to a detailed scheme for the investigation and recording of contamination including soil contamination, ground/surface water contamination, landfill gas, leachates and stability as appropriate; (b) Detailed proposals for the removal, containment or otherwise rendering harmless any contamination (the 'Reclamation Method Statement') have been determined through risk assessment and approved in writing by the Local Planning Authority; (c) The works specified in the Reclamation Method Statement have been completed in accordance with the approved scheme; Any contamination not considered in the Reclamation Method Statement but identified during the reclamation works should be subject to further risk assessment and remediation proposals agreed with the Local Planning Authority. A report demonstrating that the works were carried out in accordance with the approved scheme (the 'Validation Report') should be submitted to the Local Planning Authority within 2 months of completion of the development. REASON: The site may be contaminated as a result of past or current uses and/or is within 250 metres of a site which has been landfilled and the Local Planning Authority wishes to ensure that the proposed development can be implemented and occupied with adequate regard to environmental and public protection.
(8) Full details of boundary walls/fences shall be submitted for approval in writing by the Local Planning Authority and be constructed/erected prior to the first occupation of the dwelling hereby approved. REASON: In the interests of residential and visual amenity.
(9) The first floor window in the southern elevation of the development, and any subsequent replacement, shall be glazed throughout with obscure glass and thereafter retained to the satisfaction of the Local Planning Authority. REASON: To safeguard the living conditions of the occupants of adjacent residential properties.
REASON FOR DECISION: A detached house is proposed on land adjacent to the Railway Bridge at Windsor Road, Saltburn. This is an additional dwelling following the grant of outline planning permission for three dwellings at rear of this site and a reserved matters application (10). The proposed design is acceptable (a revised porch detail will be required to prevent encroachment onto the access). No harm to the living conditions of adjacent residential occupiers is envisaged. The proposed development would utilise the same access that is proposed for the three dwellings at the rear. This would result in four dwellings utilising the same access. The arrangements have been found to be acceptable by the Council acting as Highway Authority. The application papers indicate that the application site is in the ownership of the applicant.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1 and H3 were relevant to this decision.
