(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The first floor windows in the eastern elevation of the development, and any subsequent replacement, shall be glazed throughout with obscure glass and thereafter retained to the satisfaction of the Local Planning Authority. REASON: To safeguard the living conditions of the occupants of adjacent residential properties.
(3) This permission relates to the application as amended by a letter dated 19/4/05 received by the Local Planning Authority on 21/4/05 and the amended plan received 3 May 2005. REASON: For the avoidance of doubt.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision.
REASON FOR DECISION: Permission is sought to extend a semi-detached bungalow at 5 Low Stanghow Road, Lingdale. This dwelling is one of a number of dwellings located on the north side of the road; the land to the south comprises open agricultural land. Reference should be made to Local Plan Policies GEN1, GEN2 and H10. These policies seek to achieve development that respects the character and appearance of the area; that respects residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The proposed development would be restricted to the side and rear of the dwelling. The appearance when viewed from the front would be little changed. The roof alteration would be similar to one already undertaken at the adjoining dwelling and would introduce a sense of balance to this pair of semi detached dwellings. There are quite marked level changes at the rear of this property. The dwelling at Glen Garin, 6 Low Stanghow Road has a garage adjoining the boundary with No. 4 with an oil tank to the rear. Notwithstanding the levels changes bearing in mind the modest size of the proposed extension and the juxtaposition with Glen Garin it is considered no harm to the living conditions of the occupiers of that dwelling would result. The application proposes to extend at the rear and the submitted drawings indicate a conservatory adjoining the boundary with 4 Low Stanghow Road. The depth at boundary is shown as 2.4m (the maximum normally permitted by Local Plan Policy). It is noted that this adjoining property has a patio door with a window either side at the rear. The land immediately to the rear of the dwellings falls slightly away at the rear before falling steeply away. Bearing in mind that the roof of the conservatory would be angled away from the boundary it is considered that no harm to the living conditions of the adjoining occupiers would result. Taking into account the distance from other nearby property no harm to the living conditions of other nearby residential occupiers is envisaged. This application does not raise issues concerning either highway safety or crime prevention.
