| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | REASON FOR DECISION: Planning permission is sought to extend 26 St Annes Road, New Marske, a linked detached two storey dwelling located on the north west side of St Annes Road. The surrounding area is predominantly residential in character. It is considered that Policies GEN1, GEN2 and H10 provide the basis for determining this proposal. These policies seek to achieve development that respects the character and appearance of the area; that respects residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The proposed addition to the dwelling is of simple design with the first floor being set back from the front elevation and the ridge below that of the existing. The design achieves the aims of the Local Plan and with precednets set elsewhere. The application does not constitute overdevelopment. No harm to the character or appearance of the area is envisaged. With regard to local residential amenity, the proposed side addition adjoins the boundary with 28 St Annes Road. At No. 28 a garage adjoins the boundary (NB: The garage at No. 28 is at a higher level than shown on the submitted plans) there is a kitchen door to the rear of the garage and no windows within the first floor flank elevation. No harm to the living conditions of the occupiers of that property is envisaged. The relationship with the dwelling to the north east (No. 24) is such that no harm to the living conditions of the occupiers of that property is envisaged. The relationship with other nearby residential property is such that no harm to residential amenity is envisaged. This application shows the retention of a garage with the existing drive and as such no harm to highway safety is envisaged. This application does not compromise the aims of the Local Plan regarding crime prevention. The adequacy of foundations is a matter controlled by other legislation and not a matter for planning. |
| 3 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision. |
