# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The premises shall not be open for business between the hours of 11.30 pm on one day and 9.00 am on the following day. REASON: In the interests of amenity.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, SH7 and SH8 were relevant to this decision.
REASON FOR DECISION: It is noted that in May 1991 planning permission was granted for a change of use of these premises to a Chinese takeaway with a requirement for details of an external flue to be agreed and opening hours restricted to 11.30pm. The character of the area is one of primarily commercial premises. The use does not compromise the character or appearance of the area. This site is within the late opening zone where it would be expected to experience late night activities. There is a flat above the takeaway and the occupants have indicated they have no objections to the premises being open until 11.30. It is considered therefore that it would be difficult to sustain a refusal on amenity grounds. The application due to its location has been considered to be acceptable from a highway point of view. The application being in an area where such uses are promoted would not compromise the aims of the Local Plan with regard to crime prevention.
