8 REASON FOR DECISION: Planning permission is sought for the change of use of part of the former Uptons Department Store, High Street, Redcar into a public house. The application site is within Redcar Town Centre and the Late Opening Zone as identified on the Proposals Map of the Local Plan. Policies relevant to determining this proposal are GEN1, GEN2, SH6, SH7 and SH8. These policies seek to promote food and drink uses in the late opening zone subject to the impact of the proposal on the character and amenity of the general area; the proximity to residential property; the acceptable location of any chimneys/flues; the impact upon highway safety and the impact upon crime prevention. The Local Plan notes that Redcar is the main commercial centre of the Borough and is important for its tourist and entertainment facilities. In order to add to the attractions of the centre an area has been defined where late night opening of food and drink premises beyond 11.30 pm (but no later than 3am) is generally acceptable and enables a service to be provided for those enjoying late night entertainment. At this stage permission is sought for change of use only. External alterations will therefore need to be the subject of a later application. No harm to the character or appearance of the area is therefore envisaged. Residential accommodation in close proximity to the site is above and/or largely associated with business premises. This site is within the town centre late opening zone where it would be expected to find activity during the late evening/early hours of the morning. It is noted that Cleveland Police have not raised any objections to the proposed use. In the circumstances therefore and subject to approval of the final details (external details and sound attenuation measures) it is considered that the activities related to the use of the site would not be such that a recommendation for refusal on amenity grounds could be sustained. With regard to highway safety, the town centre location and the site proximity to both town centre parking and public transport is noted. No objections have therefore been raised on behalf of the Local Highway Authority. With regard to crime prevention, the comments of Cleveland Police are noted and as such it is considered this proposal will not therefore compromise the crime prevention aims of the Local Plan.
9 NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, SH6, SH7 & SH8 were relevant to this decision.
