# Condition Details
1 (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) The car park adjacent to 104 Marshall Drive Brotton shall not be used in connection with out of school hours use. REASON: In the interests of amenity
3 (3) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
4 (4) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
5 (5) The proposed car park extension shall be constructed in accordance with a detailed scheme first agreed in writing with the Local Planning Authority in consultation with the Local Highway Authority and thereafter maintained. REASON: In the interests of highway safety.
6 (6) Before development details of a scheme for screening the car parking area from properties on Marshall Drive shall be submitted to and agreed in writing with the Local Planning Authority. REASON: In the interests of the amenity of nearby residents.
7 REASON FOR DECISION: Permission is sought for a single storey extension and extended car park at St Peters School, Marshall Drive, Brotton. The development is to enable a children’s centre to be established at this school site. The site is within an established school complex and represents a modest addition to the complex. As such it is considered that Policies GEN1 and GEN2 provide the basis for the determination of this application. These policies seek to achieve development that respects the character and appearance of the area; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. Members will also know that provision of children’s services is high on the Government’s agenda. The proposed development would constitute a modest simple addition to the existing school building that is of a simple design and an extension to the existing car park. It is not considered therefore that the proposal would have a deleterious impact upon the character or appearance of the area. With regard to local residential amenity; the proposed extension together with three additional parking spaces would result in an intensification of the use of the school site. However, given the modest size and therefore capacity of the accommodation it is considered that the intensification of the activities at the site associated with the use would not be so great to warrant a recommendation for refusal. A restriction of the use of the car park is recommended. With regard to highways the proposed parking provision is considered acceptable subject to adequate surfacing. No harm to highway safety is therefore envisaged. The additional provision for parking is modest in relation to the recent development at this site and would not compromise the Government’s policy in seeking to encourage alternative forms of transport. The proposal would not conflict with the aims of Local Plan policy with regard to crime prevention.
