| 4 | (4) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials. |
| 5 | (5) The petrol filling station / shop; fast food outley and public house shall not operate between the hours of 23:30 and 06:00 each day. REASON: In the interests of the amenities of the area. |
| 6 | (6) Before development commences details of the lighting to the site; buildings and signs shall be submitted to and agreed in writing with the Local Planning Authority and thereafter implemented in accordance with the agreed scheme. REASON: In the interests of the amenities of the area. |
| 7 | (7) Before development is brought into use details of any advance directional signing and all site signage shall be agreed with Local Planning Authority. REASON: To ensure a satisfactory form of development. |
| 8 | (8) The existing mounding and landscaping to the perimeter of the site shall not be removed or modified unless agreed with the Local Planning Authority. Full details of any modifications shall be submitted to and agreed with the Local Planning Authority prior to development commencing. REASON: To ensure a satisfactory form of development. |
| 9 | (9) Prior to being discharged into any watercourse, surface water sewer or soakaway system, all surface water drainage from parking installed in accordance with a scheme previously submitted to and approved in writing by the Local Planning Authority. Roof water shall not pass through the inteceptor. Detergents and vehicle washings, including steam cleaning, should not discharge into the surface water drainage or via a petrol interceptor. | 10 | (10) No development approved by this permission shall be commenced until a scheme for the improvement and/or extension of the existing sewerage system has been agreed, submitted to, and approved in writing by, the Local Planning Authority. No buildings (or uses) hereby permitted shall be occupied (or commenced) until such improvements and/or extensions have been fully commissioned in accordance with the approved scheme. REASON: To prevent pollution of the water environment. |
| 11 | (11) Any facilities for the storage of oils, fuels or chemicals shall be sited on impervious bases and surrounded by impervious bund walls. The volume of the bunded compound should be at least equivalent to the capacity of the tank plus 10%. If there is multiple tankage, the compound should be at least equivalent to the capacity of the largest tank, or the combined capacity of interconnected tanks, plus 10%. All filling points, vents, gauges and sight glasses must be located within the bund. The drainage system of the bund shall be sealed with no discharge to any watercourse, land or underground strata. Associated pipework should be located above ground and protected from accidential damage. All filling points and tank overflow pipe outlets should be detailed to discharge downwards into the bund. REASON: To prevent pollution of the water environment. (For information: From 1 March 2002, the Environment Agency should be informed of any instance where the following is proposed: - more than 3500 litres of oil stored at any single private dwelling - more than 200 litres of oil at in industrial, commercial or institutional site The above activities are regulated by the Control of Pollution (Oil Storage) (England) Regulations 2001. These guidelines are intended to help reduce pollution caused by inadequate storage of oil in fixed tank installation. | 12 | (12) No development shall take place until details of a buffer strip between the development and Chapel Beck have been submitted to and approved in writing by, the Loal Planning Authority. The details shall include the landscaping arrangements. No part of the development shall be brought into use / occupied until the approved scheme has been fully implemented. The buffer strip shall thereafter be retained throughout the life of the development unless otherwise agreed in writing with the LPA. REASON: To protect ecological, recreation and amenity interests by providing a buffer between the development and the watercourse. |
| 13 | (13) Before development commences details of the vehicular access onto Middlesbrough Road and associated highway improvements including crossing facility, footways, bus laybys, relocation of speed limits and right turn facility shall be submitted to and agreed in writing with the Local Planning Authority and implemented in accordance with the agreed scheme prior to the use hereby approved commencing. REASON: In the interests of highway safety. |
| 14 | (14) Details of the extract ventilation systems shall be submitted to and agreed in writing with the Local Planning Authority and thereafter implemented in accordance with the agreed scheme. Noise from plant or extract equipment shall not exceed background noise levels by more than 3dB(A). REASON: To ensure a satisfactory form of development. |
| 15 | REASON FOR DECISION:The site is within the limits to development as set out in the Council’s Local Plan and given the planning history has been identified as a site for motorists facilities. Accordingly in land use terms the proposal accords with the development plan. Whilst a section of the perimeter mound would be removed to facilitate the new access existing mounding and landscaping would be largely retained and planting supplemented to provide a screen along the Middlesbrough Road frontage. Given this and the distance from the properties on Galley Hill, I do not consider that the development will impact on these properties to an extent that would justify referral. Concern has also been expressed regarding the noise associated with a 24 hour operation of the petrol filling station. The applicants have subsequently indicated that they would be agreeable to operating hours of 6.00 am to midnight. When approval was granted in 2000 a condition was imposed which restricted operating hours to between 6.00 and 23.30 and I consider that a similar condition should be imposed particularly in view of the fact that the scheme now includes a care home on the adjoining site. Whilst concern has been expressed by residents regarding the increase in traffic it is accepted that there is sufficient capacity to accommodate additional traffic. Furthermore the applicants have agreed to carry out a number of measures, e.g. additional footpath and crossing points which will improve pedestrian safety. However your officers consider that a protected right turn should be provided to minimise the potential for shunts. The applicants have not agreed to this but it is considered that this should still be required by condition as with the previous approval. Details of any lighting could be controlled by condition and Members will be aware that there is no right to a view under the planning regulations. Given the history of the site and the fact that the buildings will be partially screened by existing landscaping and mounding it is considered that the proposal is acceptable. |
