| # | Condition Details |
|---|---|
| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) The external elevations of the extension shall be constructed in materials to match those of the existing building. REASON: In the interests of the appearance of the development in the locality. |
| 3 | (3) The communal room indicated on the submitted plans shall be used for purposes ancillary to the use of this building as four flats and for no other purpose. REASON: For the avoidance of doubt. |
| 4 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, H11 and T6 were relevant to this decision. |
| 5 | REASON FOR DECISION: Policy H11 advises that a property will be considered unsuitable for single family use if it has more than four bedrooms and two reception rooms, and is more than two storeys in height. The adjoining properties are a B&B and flats. This site is within the limits of development. No harm to either the character or appearance of this area. No extensions are proposed and the buidling is capable of accommodating the number of units proposed. The use of the property currently a B&B as flats is unlikely to materially harm local residential amenity. The proposal therefore meets the aim of Policy H11. This application has been considered by Technical Services who advise that there is likely to be additional pressure for parking. The site has been noted to be in close proximity to public transport links and public amenities and as such it is considered that it would be difficult to substantiate a highway refusal given the Governments current advice contained in Planning Policy Guidance Note 13: Transport. The application site and surrounding area should be no more vulnerable to crime used as flats. The application notes that a rear outbuilding will be used as a communal room for residents of the flats. It is considered that a condition restricting its use to ancillary to the buildings use as flats is appropriate. |
