Conditions table
# Condition Details
(1) The development to which the permission relates must be begun not later than: i) The expiration of five years from the date of the grant of outline planning permission, or ii) If later, the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON: Required to be imposed pursuant to Section 92 of the Town and Country Planning Act 1990.
(2) Approval of the details of the siting, design, and external appearance of the building(s), the means of access thereto and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(3) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(4) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(5) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(6) Details of all boundary walls/fences shall be submitted for approval in writing by the Local Planning Authority and the approved scheme shall be implemented in its entirety prior to the first occupation of the dwelling hereby approved and thereafter maintained. REASON: In the interests of visual and residential amenity
(7) A scheme of acoustic protection shall be submitted for approval in writing by the Local Planning Authority prior to the commencement of the development hereby approved unless otherwise first agreed in writing. The approved details shall be implemented in their entirety and thereafter maintained. REASON: In the interests of visual and residential amenity.
Informative Note: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, H3, T6 and LD1 were relevant to this decision.
REASON FOR DECISION: Outline planning permission is sought for a dwelling house and detached garage on land at 19 Woodlands Drive, Normanby. The site forms part of land associated with an existing two storey semi detached dwelling, 19 Woodlands Drive. The site is within the limits of development as identified in the Local Plan by Policy LD1 and falls to be determined with consideration to Policies GEN1, GEN2, H3 and T6. These policies seek to achieve development that respects the character and appearance of the area achieving a satisfactory standard of layout and design; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The land the subject of this application is within the limits of development as identified in the Local Plan and within an established residential area. The principle of residential development is therefore acceptable at this site. Full details have been reserved for later consideration and it is likely a scheme can be achieved that respects the overall character and appearance of the area. The land currently forms part of the land associated with 19 Woodlands Drive. Detailed design and appearance has been reserved for later consideration. Given the location of this parcel of land there is no doubt a dwelling could be accommodated without detriment to the living conditions of nearby residential occupiers. The additional traffic associated with one dwelling would be unlikely to so change the existing pattern activity on the neighbouring highway as to warrant a recommendation for refusal on those grounds. The principle of the development does not raise concerns with regard to highway safety. Further, it is likely a scheme can be designed that does not compromise the aims of the Local Plan with regard to crime prevention. Members will be aware that the stipulations contained within covenants are not matters that can be resolved by the planning system.
