# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) This permission relates only to the amended plan(s) received by the Local Planning Authority on 25 January 2005. REASON: For the avoidance of doubt.
REASON FOR DECISION: Permission is sought to redevelop an existing telecommunications site at Hambleton Hill, Nunthorpe. The site is outside the limits of development and within an area identified potentially for the community forest/green wedge. Policies LD1, LD3, GEN1, GEN2, SER5 and ENV35 provide the basis for determining this proposal. These policies seek to protect land outside the limits of development unless there is special justification and where possible achieve development that respects the character and appearance of the area; that respects residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. National planning guidance relating to telecommunications development is contained in Planning Policy Guidance 8 (3). The Government’s general policy is to facilitate the growth of new and existing telecommunications systems, whilst keeping the environmental impact to a minimum and protecting public health. Authorities are advised to respond positively to proposals for such development and to understand the associated special problems and technical needs. The guidance recognises that modern telecommunications are an essential and beneficial element in the life of the local community and in the national economy. Protection from visual intrusion and the implications for subsequent network development are identified as important considerations in determining applications. The proposed mast would comprise a slimline lattice tower approximately 2.5m wide and 20m high. The mast would accommodate 3 antenna and 3 dishes for the operator ‘3’ and the T-Mobile equipment would be transferred to it. Members will be aware that Government guidance encourages site sharing. The mast and its associated ground based equipment would be enclosed within the existing compound measuring approximately 13.5m by 9.7m. The compound is located within a corner of a field surrounded by trees on its north western and south western sides. The impact of the mast on the character and appearance of the area would be limited. The trees and shrubs growing at the boundary of the field would restrict views of the mast from Gypsy Lane and beyond. It would be distantly viewed, particularly from viewpoints to the west and south west of the site. However, the mast would not, appear over prominent. Having regard to the design of the mast, its distance from the houses, the context in which it would be viewed, against the trees it is not consider that it would unduly dominate the outlook from Gypsy Lane and other residential streets in the locality. Due to the operators coverage requirements the area within which the proposed base station could be located is limited be technical considerations. Other sites in the locality have been discounted for the reasons outlined above. It is not therefore considered that the proposed development would materially harm the character and appearance of the area or the visual amenities of its residents.
As PPG8 acknowledges, health considerations and public concern can in principle be material considerations in determining applications for planning permission. However, it is for the decision-maker to determine what weight to attach to health considerations and public concern in a particular case. The Independent Expert Group on Mobile Phones, chaired by Sir William Stewart, has considered the possible health effects of the use of mobile phones, base stations and transmitters and conducted a comprehensive assessment of existing research. The ‘Stewart Report’ concluded that the balance of the evidence suggests that exposure to radio frequency (RF) radiation below National Radiological Protection Board (NRPB) and International Commission on Non-Ionising Radiation Protection (ICINRP) guidelines does not cause adverse health effects to the general population, as exposures are expected to be a small fraction of the guidelines. However, the report recognises that there are gaps in knowledge and that it is not possible to say that exposure to RF radiation below national guidelines is totally without potential adverse health effects. Consequently, the report recommended that a precautionary approach be taken to the use of mobile phone technologies until more detailed information on the health effects becomes available. It is Central Government’s responsibility to decide what measures are necessary to protect public health. The Courts have ruled that statements of national planning policy, such as PPG8, must be taken into account, where relevant, in decisions on planning applications. The Government accepted precautionary approach advised in the Stewart Report that emissions from mobile phone stations should meet ICNIRP guidelines, which are more stringent that the previous NRPB guidelines. However, as PPG8 explains, the report does not provide a basis for precautionary actions beyond those proposed. If a proposed base station meets the ICNIRP guidelines for public exposure, it should not be necessary for a planning authority in processing an application for planning permission to consider further the health aspects and concern about them. In this case, it has been confirmed that the emissions from the proposed development will be within the ICNIRP guidelines. Insensitive siting of base stations may cause anxiety to sections of the community. However, for the above reasons, it is considered the siting and appearance of the proposed mast to be acceptable. The Stewart Report acknowledges the greater vulnerability of children to RF radiation. The report recommends that particular attention should be paid to the auditing of base stations near to schools and other sensitive sites, although it does not advocate exclusions zones around schools. Following the publication of the Stewart Report, the Radiocommunications Agency has undertaken an audit programme of mobile phone base stations with a focus on base stations sites on school premises. The highest recorded value was 1/279 of the ICNIRP guidelines and typical levels were many thousands of times below the guidelines. Such data should help to allay parents’ fears. The nearest school to the proposed mast is the Primary School on the southern side of Guisborough Road from where the mast would be largely screened from view by trees and shrubs. It is not considered the proposed development to be insensitively sited so as to heighten local residents concerns. Therefore, in addition to the clear advice in PPG8 regarding the approach to be taken to perceived health risks when determining applications for telecommunications development, the specific circumstances of the proposal do not lead to the conclusion that approval should be withheld on the basis of the perceived risks to health. The Council as Highway Authority raises no objections to the proposal on highway safety grounds and there is no reason why the current access arrangements should not continue to be satisfactory. The site with two operators will be no more vulnerable to crime than with one operator.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, SER5, LD3, ENV35 & LD1 were relevant to this decision.
