| 1 | () The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision. |
| 3 | REASON FOR DECISION: This application relates to a single storey bedroom extension and a wrap around conservatory in the rear garden. The principle issue with regard to the scheme is the building over a large part of the rear garden and whether that is considered over development of the whole site. All the properties in this street are constructed on extremely small plots which is replicated on the plots to the rear. Many of the properties have been extended with extensions or free standing garages as permitted development resulting in the taking up of the majority of the rear gardens of the dwellings. Whilst this is not normally something that should be encouraged, the precedent for extensive development has already been set in the locality. The property to the rear at 13a Upper Garth Gardens has a flat roofed conservatory right up to the boundary covering most of the rear garden. A 1.8m high close boarded fence separates the two rear gardens which itself impacts upon amenity of each dwelling. I do not consider that this scheme will reduce the amenity to neighbouring occupiers to a degree that would warrant refusal. |
