# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(3) The dormer window in the eastern elevation of the development, and any subsequent replacement, shall be glazed throughout with obscure glass and top opening only and thereafter retained to the satisfaction of the Local Planning Authority. REASON: To safeguard the living conditions of the occupants of adjacent residential properties.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision.
REASON FOR DECISION: Permission is sought to construct a rear dormer window at 6 The Larches, Ormesby a semi detached bungalow located within an established residential area. It is considered that Policies GEN1, GEN2 and H10 of the Local Plan provide the basis for determining this application. These policies seek to achieve development that respects the character and appearance of the area; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The proposed dormer window would be both set in from the sides of the roof and up from the eaves level. Within the vicinity of this site other dormers can be found; some within the front roof slope. It is not considered therefore that the current proposal would be so detrimental to the character or appearance of the area that planning permission ought to be refused. With regard to local residential amenity; the main concern with regard to this proposal has been the distance between the rear of this property and those on Laburnum Road which are less than 21 metres apart. In this instance, the applicants have advised that they are happy for the rear windows to be obscure glazed and top opening only to avoid any problems with overlooking. Any means of escape required by the Building Regulations could be via a roof light that the applicants propose within the front roof slope (not requiring planning permission). With regard to sound insulation, if required, this will be incorporated as part of the Building Regulations. The impact upon property values and the operation of the Party Wall Act are not matters for the planning regime. This application does not raise concerns regarding either highway safety or the crime prevention aims of the Local Plan. The Committee agreed the application for the reasons outlined above.
