# Condition Details
1 (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) A scheme for the extraction and treatment of effluvia from the cooking equipment shall be submitted to and approved in writing by the Local Planning Authority and the approved scheme implemented before the use hereby permitted is commenced. Thereafter, the approved scheme shall be maintained and operated in accordance with the manufacturer's specifications. REASON: In the interests of the amenities of the occupants of residential properties in the locality.
3 (3) The premises shall not be open to customers outside the hours of 0900 to 2330, Monday to Saturday, nor at any time on Sunday. REASON: In the interests of the amenities of the locality.
4 NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, SH2 and SH7 were relevant to this decision.
5 REASON FOR DECISION: The proposed development is considered to be appropriate within this existing commercial centre. It would not have an adverse impact on the character and amenity of the area. The application does not raise any issues in respect of crime prevention or adversely affect highway safety. The proposal accords with the Council's adopted Local Plan.
