() The development to which the permission relates must be begun not later than: i) The expiration of five years from the date of the grant of outline planning permission, or ii) If later, the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON: Required to be imposed pursuant to Section 92 of the Town and Country Planning Act 1990.
(2) Approval of the details of the design, external appearance of the buildings, materials and the landscaping of the site (hereinafter called the "reserved matters") shall be obtained before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(3) Details of any boundary means of enclosure shall be submitted to and agreed in writing with Local Planning Authority. REASON: In the interests of the visual amenities of the area.
(4) No trees shall be removed unless the prior consent of Local Planning Authority has been obtained. REASON: In the interests of the amenity of the area.
(5) No development shall take place until a flood risk assessment has been undertaken. The floor levels of the dwelling and the flood protection measures shall be submitted to and agreed with Local Planning Authority. REASON: To reduce the risk from flooding.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H3 were relevant to this decision.
REASON FOR DECISION: The application is an outline application for the erection of a detached bungalow on land off East Crescent, Loftus. The plans show the position of the bungalow and the access point but details of design and external appearance are reserved for future consideration. The site is within the limits to development as set out in the Council’s Local Plan. The site forms part of the former Timber Yard site but has not been previously developed. With regards to access the scheme includes two on-site parking spaces together with a turning area. Whilst concerns have been expressed by local residents regarding additional traffic, Technical Services advise that the access arrangements are considered to be acceptable. Furthermore members will be aware that consent was recently granted for an additional dwelling on land to the west of Micklow Terrace which also accessed on to East Crescent, even though the existing road at this point was narrower. The area where the dwelling would be built has largely been cleared of shrubs and a condition could be imposed to control the removal of any trees. The bungalow has been positioned so as not to be directly in front of existing properties on East Crescent. Furthermore the bungalow would be positioned at a lower level which would further reduce the impact on adjacent properties. The site is however in a flood risk zone. In this instance the Environment Agency does not object to the scheme provided that the bungalow is positioned above the existing ground levels. Conditions will need to be imposed to ensure that adequate flood protection measures are incorporated. Given that the site is within the limits to development and that there are no highway objections then it is considered that it would be difficult to justify refusal of the application.
