# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Noise emitted from the operation of the proposed development shall not exceed current background noise levels, when measured at the site boundary. REASON: To ensure a satisfactory form of development.
Informative Note: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and SER3 were relevant to this decision.
REASON FOR DECISION: Members will be aware that the Bran Sands Plant treats both domestic and industrial waste streams from the local area. Since it was originally commissioned the plant has been developed to accommodate additional industrial customers. The development now proposed is to treat additional waste from DuPont SA at the Wilton Site. Currently Bran Sands treats their liquid waste but “solid flake” goes to landfill sites. As a consequence of the EU Land Direction this will cease to be a viable option in July 2005. The proposal therefore is to mix the liquid and flake streams and treat this in the new facility. The new plant would be located within the boundary of the existing treatment works. The proposed development comprises four treatment and re-circulation tanks (between 18 and 24m high); bio gas holder, two gas flare stacks (11m high) which are encased and associated pipework and chemical storage area. In visual terms the proposed development will be seen against the backdrop of the existing treatment works and other industrial plant. Whilst the tanks are higher than the existing ones immediately adjacent (23 metres compared with 15m) the difference would not be significant in the wider views from the Trunk Road particularly in view of the fact that there are other much taller structures in the immediate vicinity. Noise The development has the potential to generate noise both during the construction and operational periods. Good working practices will be adopted during the construction phase to minimise noise levels and equipment will be designed so that once operational noise levels will not exceed existing background noise levels. Air Quality/Water Quality Potential emissions have been considered as part of the Environmental Assessment. The results of the assessment indicate that emissions will not exceed air quality objectives and therefore will not be an issue. The development will result in increased effluent being discharged to the Tees Estuary. This will take place under the existing discharge consent which is enforced by the Environment Agency. Even for those elements where some increase is predicted eg cobalt and maganese, the increase is not sufficient to cause significant water quality deterioration. Odour Potential odour emissions from the proposed plant were also assessed. The gas flares are encased and wastewater is neutralised before being treated in the new plant. Off –gas emissions from the anaerobic process will be transferred to the existing odour scrubbers within the Bran Sands plant. These measures will reduce the potential for odour emissions. Accordingly it is considered that odour will not be an issue, particularly in view of the fact that the plant is a considerable distance from sensitive receptors. Given that the proposed treatment plant will reduce material going to landfill, the project accords with principles of sustainability. The Environmental Assessment concludes that the development will have no adverse environmental affects, a view that is endorsed by Environmental Health officers and the Environment Agency. The proposal is an extension to the existing treatment works which is an important facility for industrial operations in the area. The development will enable DuPont SA to comply with the EU Landfill Direction. The proposal therefore accords with National and Local Policies. Accordingly I would recommend that the application be approved.
