# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 18 of the Planning (Listed Buildings and Conservation Areas) Act 1990.
(2) The permission relates solely to the amended plans received on 26 November 2004. REASON: For the avoidance of doubt.
(3) Samples of the materials to be used shall be submitted to and agreed with the Local Planning Authority. L REASON: To ensure a satisfactory form of development.
(4) The developer shall give two weeks notice in writing of commencement of works to Tees Archaeology, Sir Williams Gray House, Clarence Road, Hartlepool, TS24 8BT, telephone (01429) 523458, and shall afford access at all reasonable times to Tees Archaeology and shall allow observation of the excavations and recording of items of interest and finds. REASON: The site is of archaeological interest.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and ENV10 were relevant to this decision.
REASON FOR DECISION: The proposal is to build an attached garage at the rear of the property. Holly House is a Grade II Listed Building built in the mid nineteenth century. The proposed garage would be located at the rear of the premises. The design of the proposed garage is acceptable and the materials proposed are in keeping with the original dwelling house. Vehicular access would be as existing ie. from Westgate down the side of the dwelling. The only objection received relates to a right of way. The applicant maintains he does not consider there is a right of way at the rear of the property. In any event Members will be aware that rights of way are a civil issue rather than a planning matter since the grant of planning permission does not override civil considerations. The proposed garage is acceptable in planning terms and consent granted on this basis.
