# Condition Details
(1) The development to which the permission relates must be begun not later than: i) The expiration of five years from the date of the grant of outline planning permission, or ii) If later, the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON: Required to be imposed pursuant to Section 92 of the Town and Country Planning Act 1990.
(2) Approval of the details of the siting, design, and external appearance of the building(s), the means of access thereto and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(3) The application site is on/close to land identified by the council as having a history of potentially harmful contamination. The applicant shall, prior to the commencement of any works involving the disturbance of the site, submit for the approval of the Planning Authority i) details of a suitable site investigation and risk assessment sufficient to identify the nature and degree of any contaminants in, on or under the site and the extent to which they may effect the suitability of the site for its intended use. ii) dependent on the findings of i) above, details of a suitable remediation scheme. The agreed scheme shall be implemented to the satisfaction of the Local Planning Authority prior to the development commencing. REASON: In the interests of public safety.
() The extension to the stable shall be used for storage purposes only. REASON: In the interests of the amenities of the area.
() On completion of the bungalow, any animals in the stables shall be kept by the same person as occupies the bungalow. REASON: To ensure a satisfactory form of development.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H4 were relevant to this decision.
REASON FOR DECISION: The application site for the proposed dwelling and stable extension is within the Limits to Development as defined within the Council’s Local Plan. This site has been previously developed and can be considered as a ‘brown field’ site. The siting, external appearance and landscaping have been reserved for future consideration, however the applicant has submitted for illustrative purposes only the location of the dwelling which indicates the minimum separation distances the Council require through its local plan can be achieved. The main issue therefore is the use of the access at the end of the terrace and whether this creates problems of highway safety. The road is approximately 5m wide and is used to access the rear of the properties on the High Street and the disused garage and the stabling and horse fields further north. Technical Services have acknowledged that visibility is restricted when leaving the site however it is not considered at a level that would lead to the application being refused. I am of the opinion therefore that this proposal is considered acceptable. In respect of the stable extension this comprises of a 4 m x 5 m blockwork building attached to the northern end of the existing stable and is to be used for storage purposes. The building will match to existing building and is in a location that will not impact on neighbouring properties or the area generally and is considered acceptable.
