| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) Before development commences details of the means of enclosure of the site shall be submitted to and agreed in writing by Local Planning Authority and thereafter shall be erected in accordance with the agreed scheme prior to any of he units being occupied. REASON: To ensure a satisfactory form of development. |
| 3 | (3) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order, 1995, (or any Order revoking or re-enacting that Order) no enlargement of the dwelling(s) the subject of this permission shall be carried out without the express consent of the Local Planning Authority. REASON: To safeguard the character and appearance of the development. |
| 4 | REASON FOR DECISION:The property is within a predominantly residential area within the limits to development. Accordingly use of the building for residential purposes would be acceptable on principle. Furthermore the proposed conversion works are considered to be acceptable. There are two main issues with regard to this proposal namely the effect on neighbouring properties and the parking arrangements. The single storey flat roofed elements of the building would be demolished. The cleared areas would be used as rear garden areas and for parking for one or two vehicles. Whilst the roof space would be utilised, only rooflights would be installed in the roof area overlooking the properties on Parkside. The main windows would be at ground floor level. Given the separation distance and relationship with these adjacent properties I do not consider that using the property for residential purposes would affect the privacy or result in overlooking to an unacceptable degree. Furthermore a condition would be imposed with respect to fencing to ensure that the site is made secure. Technical Services have also expressed concern regarding the lack of manoeuvring space within the site. 5(no) parking spaces will be provided along the frontage and a further six spaces at the side and rear. Accordingly the number of spaces is adequate for the proposed development. Whilst it is accepted that the manoeuvring space is tight, given the previous use of the premises which had the potential to generate more traffic and Government advice that within town centres, travel by means other than cars should be encouraged, I consider it would be difficult to sustain a refusal of the application on this ground. I would therefore recommend that the application be approved. |
