# Condition Details
1 (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) No development shall commence until a landscaping scheme to upgrade the existing tree/hedge belt to the north of the compound has been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented prior to the commencement of the development hereby approved and shall be maintained until it becomes established. REASON: In the interests of visual amenity.
3 (3) The proposed compund fence and ancillary cabinet shall be coloured green in accordance with details to be agreed in writing with the Local Planning Authority prior to their installation onsite and shall therafter to retained. REASON: In the interests of visual amenity.
4 REASON FOR DECISION:Planning permission is sought for a 18 metre high monopole and ancillary development within a 6 metre by 6 metre compound at Saltburn Golf Club, Saltburn. The site is outside the limits of development and within an area designated as an Inland Special Landscape Area and where there is a long term strategy to create a community forest where Polices GEN1, LD1, ENV24, ENV35 and SER5 provide the basis for determining this application. The proposed development is required to provide 3G coverage within the locality. Government advice is for operators to seek to mast or site share or utilise suitable and available tall buildings. In this case, a site adjacent to existing operators compounds is deemed acceptable as it minimises the need to find an alternative location and this restricts the impact to this location thus minimising the impacts upon the wider countryside. As PPG8 acknowledges, health considerations and public concern can in principle be material considerations in determining applications for planning permission. However it is for the decision maker to determine what weight to attach to health considerations and public concern in a particular case. The Independent Expert Group on Mobile Phones, chaired by Sir William Stewart has considered the possible health effects of the use of mobile phones, base stations and transmitters and conducted a comprehensive assessment of existing research. The ‘Stewart Report’ concluded that the balance of the evidence suggests that exposure to radio frequency (RF) radiation below National Radiological Protection Board (NRPB) and International Commission on Non-Ionising Radiation Protection (ICNIRP) guidelines does not cause adverse health effects to the general population, as exposures are expected to be a small fraction of the guidelines. However the report recognises that there are gaps in knowledge and that it is not possible to say that exposure to RF radiation below national guidelines is totally without potential adverse health effects. Consequently, the report recommended that a precautionary approach be taken to the use of mobile phone technologies until more detailed information on the health effects becomes available. It is Central Government’s responsibility to decide what measures are necessary to protect public health. The Courts have ruled that statements of national planning policy such as PPG8 must be taken into account where relevant in decisions on planning applications. The Government accepted the precautionary approach advised in the Stewart Report that emissions from mobile phone stations should meet ICNIRP guidelines which are more stringent than the previous NRPB guidelines. However as PPG8 explains the report does not provide a basis for precautionary actions beyond those proposed. If a proposed base station meets the ICNIRP guidelines for public exposure it should not be necessary for a planning authority in processing an application for planning permission to consider further the health aspects and concern about them. In this case it has been confirmed that the emissions from the proposed development will be within the ICNIRP guidelines. The insensitive siting of base stations may cause anxiety to sections of the community. However it is considered that the siting and appearance of the proposed mast to be acceptable.
