# Condition Details
1 The proposed dining room by virtue of its size and location would have a detrimental affect on the amenities of adjacent residents. The proposal is contrary to Policy H10 of the Council's adopted Local Plan.
2 NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision.
3 REASON FOR DECISION: Permission is sought to extend 20 Grosvenor Gardens, Normanby, which is located within a well established residential area. As such it is considered Policies GEN1, GEN2 and H10 provide the basis for the determination of this proposal. These policies seek to achieve development and respect the character and appearance of the area, which respects residential amenity and does not compromise highway safety and the crime prevention aims of the Local Plan. It is anticipated that the proposed conservatory would not cause significant harm to the amenities of local residents or adversely affect the character and appearance of the area. The principle concern relates to the proposed dining room extension sited on the boundary, which would extend 3 metres along the boundary. A 3 metre extension on the boundary is considered to be unacceptable and would have an adverse effect on the amenity of adjoining residents. The Council’s Local Plan states that 2.4 is the maximum distance that is permitted on the boundary with semi-detached houses in order to protect the amenity of the neighbouring properties. The agent has been requested to reduce the size of the extension but has asked for the application to be considered as submitted. The proposal does not give cause for concern from a design or highway safety point of view and does not compromise the crime prevention aims of the Local Plan.
