(2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(3) This permission relates only to the amended plan(s) received by the Local Planning Authority on 19 November 2004 and 3 December 2004. REASON: For the avoidance of doubt.
(4) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(5) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.

REASON: To ensure that existing trees/hedges on and adjacent to the site which are to be retained, are protected from vehicles and works involved in the construction of the development.
(8) The application site is on/close to land identified by the council as having a history of potentially harmful contamination. The applicant shall, prior to the commencement of any works involving the disturbance of the site, submit for the approval of the Planning Authority i) details of a suitable site investigation and risk assessment sufficient to identify the nature and degree of any contaminants in, on or under the site and the extent to which they may effect the suitability of the site for its intended use. ii) dependent on the findings of i) above, details of a suitable remediation scheme. The agreed scheme shall be implemented to the satisfaction of the Local Planning Authority prior to the development commencing. REASON: In the interests of public safety.
(9) Details of any external lighting proposed as this side shall be submitted for approval in writing by the Local Planning Authority. Only an approved lighting scheme shall be implemented at this site. REASON: In the interests of visual and residential amenity.
(10) The layby shall be deleted from the proposed scheme and a footpath installed along the Guisborough Road frontage to the satisfaction of the Local Planning Authority prior to any of the units hereby approved being occupied. REASON: In the interests of highway safety.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, H3, T6 and LD1 were relevant to this decision.
REASON FOR DECISION: Permission is sought for the redevelopment of the Chris Myers Cars site at Guisborough Road, Nunthorpe for residential purposes comprising a development of two blocks of apartments, associated access and parking and a cycle/bin store. The triangular shaped site lies to the north east of the Middlesbrough to Whitby railway line with residential property to both the north east, east and north west. In addition the local shops also identified as a Local Shopping Area are located to the north west of this site and a childrens nursery to the north east. This site is within the limits of development (11) and as such it is considered that the main policy considerations are those expressed by Policies GEN1, GEN2, H3 and T6 of the Local Plan. These policies seek to achieve development that respects the character and appearance of the area by achieving a satisfactory design and layout that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The site currently comprises land and buildings used for car showroom and garage purposes. The proposed redevelopment of the site has been designed to reflect the domestic scale of properties fronting Guisborough Road whilst taking advantage of the sites location adjacent to the railway line to achieve a linear form parallel with the railway line making optimum use of the site and achieving the aims of national planning policy in seeking to achieve high densities on ‘brownfield sites’. It is therefore considered that due to its location, size and design the proposed development would not have a detrimental impact upon the character and appearance of the area. With regard to local residential amenity; the location, siting and design of the proposed buildings on the site are such that the minimum separation distances are achieved. It is considered that there would be no loss of privacy. Access would be on to Guisborough Road and thus the expected vehicular activity associated with the proposal would be unlikely to constitute harm to the living conditions of nearby residential occupiers. The submitted layout indicates a vehicular access between the two proposed blocks onto Guisborough Road and incorporates a footpath along the sites frontage with a lay-by for use by refuse or delivery vehicles. The expected traffic generation would not compromise highway safety and the general layout has been found to be satisfactory in highway terms. The proposed layout would be subject to light, landscaping and boundary details (to be agreed). Subject to satisfactory details being submitted it is considered that as the site provides opportunities for passive surveillance the proposal would not compromise the crime prevention aims of the Local Plan. Concern has been raised regarding potential flooding at the site. Members will note that Northumbrian Water have raised no objections to the development, but note that if surface water is proposed to be disposed of through the public surface water or combined sewers Northumbrian Water must be consulted. Ultimately it will be of the developer to ensure adequate disposal of surface water at this site. The Council agreed the application for the reasons outlined above.
