| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. | 3 | (3) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality. |
| 4 | (4) Detailed plans of the dwelings to be erected on each plot (including external materials) shall be submitted to and approved by the Local Planning Authority before development is commenced. REASON: To reserve the rights of the Local Planning Authority with regard to these matters. |
| 5 | (5) The dwellings to be erected on each plot shall be positioned within the 'footprint' indicated on drawings no. 33/P/7/A. REASON: To ensure that each dwelling retains an acceptable co-ordinated relationship in the interests of visual amenity. |
| 6 | (6) i) The highway works shall be designed in accordance with the Council's design standards for roads serving residential development, and ii) works to be carried out in accordance with the Council's standard specification for roads, sewer and street lighting works serving private development in order to secure adoption and the details to be submitted to the Director of Development at least one month before the commencement of works. REASON: To ensure a satisfactory form of development. |
| 7 | (7) Notwithstanding Condition 5 above, the formation of the landscape mounding adjacent to the Redcar Road frontage shall be sully implemented, during the first available planting season following commencements of development. REASON: In the interests of the visual amenities of the locality. |
| 8 | (8) The existing hedges and trees shall be retained unless the prior consent of the Local Planning Authority has been obtained. REASON: In the interests of the amenities of the area. |
| 9 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and LD1 were relevant to this decision. |
| 10 | REASON FOR DECISION: The principle of residential development on this site was established in 1990 and the site incorporated in the Local Plan as a committed future housing site. The layout was approved as a reserved matters application in 1993. The situation has not altered since that time. With regard to the residents concerns, the site is within the limits of development and does not affect the green wedge between Marske and Redcar. The site has been taken into account in the overall housing figures in the Local Plan and loss of view is not a material planning consideration. Given that the site is included in the Local Plan and the layout is acceptable in highway terms, I do not consider that there are any reasons to justify refusing consent for a renewal of the permission. I would therefore recommend that the application be approved. |
