5 NOTE: Redcar and Cleveland Local Plan Policies GEN1, LD1, ENV35 and SER5 were relevant to this decision.
6 REASON FOR DECISION: Planning permission is sought for a 20 metre high lattice mast and ancillary cabinets of a telecommunications site currently accommodating a 15 metre high monopole and ancillary cabinet. The 20 metre high mast would replace the 15 metre high mast on land at Pybus Field, Grewgrass Farm, Grewgrass Lane, Redcar. This site is within an agricultural field outside the limits of development as identified by Policy LD1 and within an area where a long term strategy is to create a community forest (5). In addition to these Policies GEN1, and SER5 also provide the basis for determining the proposal. These policies seek to achieve telecommunications development where its is designed and located to minimise its visual impact and that evidence is provided to justify the development. The proposed development is located within the north west corner of an agricultural field adjacent to a tree line and shrub/hedge belt. An electricity pylon and overhead lines can be found to the east crossing the field. Taking this into account it is considered that the mast would not so despoil the visual amenity of its immediate surroundings to warrant a recommendation that planning permission ought to be refused. There is a residential bungalow located to the west of the tree line referred to above. The proposed location of the development is such that it is not considered that the living conditions of the occupiers of that property would be materially harmed. With regard to any health concerns as PPG8 acknowledges, health considerations and public concern can in principle be material considerations in determining applications for planning permission. However, it is for the decision-maker to determine what weight to attach to health considerations and public concern in a particular case. The Independent Expert Group on mobile phones, chaired by Sir William Stewart, has considered the possible health effects of the use of mobile phones, base stations and transmitters and conducted a comprehensive assessment of existing research. The ‘Stewart Report’ concluded that the balance of the evidence suggests that exposure to radio frequency (RF) radiation below National Radiological Protection Board (NRPB) and International Commission on Non-Ionising Radiation Protection (ICNIRP) guidelines does not cause adverse health effects to the general population, as exposures are expected to be a small fraction of the guidelines. However, the report recognises that there are gaps in knowledge and that it is not possible to say that exposure to RF radiation below national guidelines is totally without potential adverse health effects. Consequently, the reports recommended that a precautionary approach be taken to the use of mobile phones technologies until more detailed information on the health effects become available. It is Central Government’s responsibility to decide what measures are necessary to protect public health. The Courts have ruled that statements of national planning policy, such as PPG8, must be taken into account, where relevant, in decisions on planning applications. The Government accepted the precautionary approach advised in the Stewart Report that emissions from mobile phone stations should meet ICNIRP guidelines, which are more stringent than the previous NRPB guidelines. However, as PPG8 explains, the report does not provide a basis for precautionary actions beyond those proposed. If a proposed based station meets the ICNIRP guidelines for public exposure, it should not be necessary for a planning authority in processing an application for planning permission to consider further the health aspects and concern about them. In this case, it has been confirmed that the emissions from the proposed development will be within the ICNIRP guidelines
