| 7 | REASON FOR DECISION: Members will recall that this site was recently the subject of a planning application for the construction of a dwelling which was refused and subsequently dismissed at appeal. The applicant has put forward this proposal on the basis that he wishes to utilise the land which he does not consider to be appropriate as an extension of his garden because of its location. The original submission included 3 rooflights in the roof slope on the eastern side and a steeper pitch to the roof. This led neighbours to query the purpose of the building and its possible conversion to a dwelling. Following discussions with the applicant the pitch has been reduced and the rooflights omitted and confirmation from the applicant that this is only for a domestic garage. In any event any other use put to the building other than ancillary domestic purposes would require a further planning application. The land is basically rectangular in shape approximately 34m long measured from the highway and between 10m and 13m wide as you go into the site. The issue with regard to this proposal is the effect of the development on neighbouring properties. The properties to the east on Hampstead Road and 2 Mayfair Avenue are well screened by existing fences and high hedges and mature trees and consequently this development would not cause harm to the living conditions of residents. On the west side the greatest impact would be on 2 Kew Rise who backs onto the site, however their rear garden is approximately 9.75m long with a low larch lap fence defining the boundary. The proposed side wall of the garage would be 3m from that boundary. Appendix 10 of the Local Plan gives advice on separation distances and states that a distance of 13m from a rear or front wall of a property to a side wall of an adjoining property without windows is normally considered acceptable. In the circumstances therefore I consider this proposal acceptable. |
