| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | REASON FOR DECISION: Permission is sought to erect a garage and kitchen extension at side of 30 Ryehills Drive, Marske a semi detached house located within a well established residential area. As such policies GEN1, GEN2 and H10 provide the basis for the determination of this proposal. These policies seek to respect the character and appearance of the area; residential amenity and that development does not compromise highway safety or the crime prevention aims of the local plan. The dwelling does not give cause for concern and respects the street scene and scale of the dwelling. With regard to residential amenity, the garage is almost completely in line with the neighbouring property which has extended their garage previously. The proposed works would extend approximately 20centimetres to the south and 50 centimetres to the north of the existing garage at 28 Ryehills Drive. With regard to the neighbours concerns of overshadowing whilst it is acknowledged that some loss of light will occur to the rear conservatory at 28 Ryehills the room would still receive light from the rear window which would not be affected and it is not considered that the effect would be so detrimental to the living conditions for the occupants of number 28 Ryehills Drive as to justify refusal. As members will be aware issues relating to drainage, foundations and land ownership are not planning considerations. |
| 3 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision. |
