# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) The external elevations of the extension shall be constructed in materials to match those of the existing building. REASON: In the interests of the appearance of the development in the locality.
(3) The first floor dormer window in the eastern elevation of the development, and any subsequent replacement, shall be glazed throughout with obscure glass and top opening only and thereafter retained to the satisfaction of the Local Planning Authority. REASON: To safeguard the living conditions of the occupants of adjacent residential properties.
(4) This permission relates to the additional plans submitted on 24 June 2004 and 21 September 2004. REASON: For the avoidance of doubt.
REASON FOR DECISION: Permission is sought for extensions to a bungalow at 7 Lowcross Avenue, Guisborough. It is considered that Policies GEN1, GEN2 and H10 provide the basis for determining this proposal. These policies seek to achieve development that respects the character and appearance of the area; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The proposed side extension would adjoin the western elevation of the bungalow and thus be fronting Thweng Way. Local Plan policy design guidance seeks to ensure that where development is proposed on corner plots that the distance from the building to the back edge of the pavement is not less than 3 metres in the case of single storey extensions. The distance remaining between the proposed extension and the boundary of the site would be at least 3 metres. Between the boundary hedge and the footway is a grassed verge. The proposal therefore meets the aims of policy with regard to distances. The existing detached garage is forward of the west elevation of the building and the proposed extension would be viewed against this backdrop. It is not considered therefore that the extension would compromise the character and appearance of the area. The dormer would be inserted within a roof slope not visible from the public domain and as such would not have a detrimental impact upon the character and appearance of the area. The proposed pitched roof over the existing garage would improve the appearance of the garage as this is clearly visible from several vantage points. No harm to the character or appearance of the area is therefore envisaged. With regard to local residential amenity, the siting design and location of both the side extension and the garage are such that no harm to the living conditions of nearby residential occupiers is envisaged. The proposed dormer would face onto the private rear garden/yard areas of dwellings to the east. It is therefore considered that any window should be obscure glazed and top opening only in order to maintain privacy. This may be achieved by condition. This application does not raise concerns regarding either highway safety or the crime prevention aims of the Local Plan.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision.
