| 5 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, SH1 and SH7 were relevant to this decision. |
| 6 | REASON FOR DECISION: This property is situated within a small parade of shops close to the junction of West Terrace and The Esplanade opposite the public toilets and tourist information office. The property to the north compromises of flats and a fish and chip ship and a public house lies to the south. The site lies within the town centre boundary of Redcar. Members will be aware that the Council operate safeguarding policies when dealing with hot foot takeaways and cafes which include not allowing such establishments when adjacent to residential properties. In this particular case the proposal to change an empty shop unit into an A3 use is slightly unusual as most of the premises in the vicinity are late night uses including public house, take away and amusement arcades. The Entertainment Zone allocated within the Local Plan commences on the opposite side of the road. However, because residential accommodation abuts the site the scheme is in conflict with Policy SH7 of the Local Plan. I am of the opinion that the location of this proposal amongst many similar uses creates a special circumstance that would allow this proposal to go ahead, particularly as no neighbour representation have been received which is probably on the basis that they already live in an environment close to the sea front entertainments, licensed premises and takeaway shops and accept that their location is likely to attract other such uses at ground floor. The effluvia venting system at the rear has been located close to the existing system for the fish and chip shop and will not be visible from locations other than at the rear of the premises. Discussions are ongoing in respect of the shop front design but at this point in time the applicant is concerned at the principle of the use being acceptable and therefore if the Planning Committee resolve to approve this application a condition would be attached requiring that element to be submitted at a future date. |
