1 It is recommended that prior approval be granted under the provisions of Part 24 of Schedule 2 to the Town and Country Planning (1) Order 1995 (as amended) for the siting and appearance of 6 panel antennaes, a radio equipment cabinet and ancillary development.
2 NOTE: Redcar and Cleveland Local Plan Policies GEN1 and SER5 were relevant to this decision.
3 REASON FOR DECISION: The prior approval of this Authority is required for the siting and appearance for six panel antennas, equipment cabin, cable ladder and support poles and 2.1 metre fence enclosure at Town Hall, Fabian Road, Eston. It is considered that Policies GEN1 and SER5 provide the basis for determining the proposal. These policies seek to achieve development that seeks to minimise its visual impact respecting the character and appearance of the area. National planning guidance relating to telecommunications development is contained in Planning Policy Guidance 8 (PPG8). The Government’s general policy is to facilitate the growth of new and existing telecommunications systems, whilst keeping the environmental impact to a minimum and protecting public health. Authorities are advised to respond positively to proposals for such development and to understand the associated special problems and technical needs. The guidance recognises that modern telecommunications are an essential and beneficial element in the life of the local community and in the national economy. Protection from visual intrusion and the implications for subsequent network development are identified as important considerations in determining applications. The six panel antennas are to be installed on an existing mast and ancillary development adjacent to it. The site is to the north east of the Town Hall annex. The alterations to the site would have a limited impact upon the character and appearance of the area; altering little the distant views across the field from Church Lane. With regard to the health concerns raised PPG8 does not identify health issues as one of the factors to be considered in respect of the siting and appearance of telecommunications equipment. However, PPG8 acknowledges health considerations and public concern can in principle be material considerations in determining applications for planning permission. However, it is for the decision maker to determine what weight to attach to health considerations and public concern in a particular case. The Independent Expert Group on Mobile Phones, chaired by Sir William Stewart, has considered the possible health effects of the use of mobile phones, base stations and transmitters and conducted a comprehensive assessment of existing research. The ‘Stewart Report’ concluded that the balance of the evidence suggests that exposure to radio frequency (RF) radiation below National Radiological Protection Board (NRPB) and International Commission on Non-Ionising Radiation Protection (ICNIRP) guidelines does not cause adverse health effects to the general population, as exposures are expected to be a small fraction of the guidelines. However, the report recognises that there are gaps in knowledge and that it is not possible to say that exposure to RF radiation below national guidelines is totally without potential adverse health effects. Consequently, the report recommended that a precautionary approach be taken to the use of mobile phone technologies until more detailed information on the health effects becomes available. It is Central Government’s responsibility to decide what measures are necessary to protect public health. The Courts have ruled that statements of national planning policy, such as PPG8, must be taken into account, where relevant, in decisions on planning applications. The Government accepted the precautionary approach advised in the Stewart Report that emissions from mobile phone stations should meet ICNIRP guidelines, which are more stringent than the previous NRPB guidelines. However, as PPG8 explains, the report does not provide a basis for precautionary actions beyond those proposed. If a proposed base station meets the ICNIRP guidelines for public exposure, it should not be necessary for a planning authority in processing an application for planning permission to consider further the health aspects and concern about them. In this case, it has been confirmed that the emissions from the proposed development will be within the ICNIRP guidelines.
