# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) This permission relates only to the original plans submitted on 10 May 2004 for the first floor extension and the amended plans submitted on 30 June 2004 for the conservatory. REASON: For the avoidance of doubt.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision.
REASON FOR DECISION: Permission is sought for a first floor side extension and a rear conservatory at 163 Woodhouse Road, Guisborough a two storey semi detached dwelling located within an established residential area. It is considered that Policies GEN1, GEN2 and H10 provide the basis for determining this proposal. These policies seek to achieve development that respects the character and appearance of area; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The first floor extension due to its design would not detract from the appearance of the existing dwelling or the area as a whole. It would both be set in from the boundary and due to the curve in the road is angled away from the adjacent property and as such a “terracing” effect would not result. No harm to either the character or appearance of the area would result. The rear conservatory is of a simple design and due to the size of the dwelling and the plot size would not constitute overdevelopment. No harm to the character or appearance of the area is envisaged. With regard to residential amenity; the first floor extension would be above an existing garage in close proximity to the bounday with 161 Woodhouse Road. Being on a curve in the road the two properties are angled away from each other. 161 Woodhouse Road has a first floor window within its side elevation and a window within the single storey side ‘wash house’. Windows are proposed within the front and rear elevations of the extension. Due to the relationship of the two properties no harm to the living conditions of the occupier of 161 Woodhouse Road is envisaged. This extension would be no closer to properties to the front and rear than the existing property. It would not therefore adversely impact upon other neighbouring property. The proposed conservatory would be adjacent to the boundary with 165 Woodhouse Road. As the development is set in from the boundary its depth where it runs parallel with the boundary is considered acceptable and would protect the living conditions of the adjoining occupiers. Due to its size, design and location the conservatory would not compromise the living conditions of any other nearby residential occupiers. The application proposal maintains both a garage space and vehicle hardstanding and as such would not be detrimental to highway safety. This application does not raise concerns with regard to the crime prevention aims of the Local Plan.
