| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) The permission related solely to the amended plans received on 13 July 2004. REASON: For the avoidance of doubt |
| 3 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision. |
| 4 | REASON FOR DECISION: Permission is sought to extend 15 Ryehills Drive semi-detached two-storey dwelling located within a well established residential area. As such it is considered policies GEN1, GEN2 and H10 provide the basis for the determination of this proposal. These policies seek to achieve development and respect the character and appearance of the area which respects residential amenity and does not compromise highway safety and the crime prevention aims of the Local Plan. The design and scale of the proposed rear extension does not give cause for concern. Amended drawings have been submitted reducing the length of the extension along the party boundary so that it complies with Policy H10 of the Local Plan which seeks to restrict rear extensions at semi detached houses to a depth of 2.4 metres. The proposal now measures approximately 2.38 metres on the boundary. With regard to residential amenity the proposal would not have a significant adverse effect upon the occupier of 13 Ryehills Drive. The proposed brick wall adjacent to the boundary would not be significantly higher than a standard 2 metre high fence. The visual impact would not compromise the amenity of the occupants of 13 Ryehills Drive. As members will be aware any encroachment issues and maintenance of boundaries are civil matters and are not planning considerations. The application causes no concerns relating to the crime prevention aims of the Local Plan. |
