# Condition Details
(1) The development to which the permission relates must be begun not later than: i) The expiration of five years from the date of the grant of outline planning permission, or ii) If later, the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON: Required to be imposed pursuant to Section 92 of the Town and Country Planning Act 1990.
(2) Approval of the details of the siting, design, and external appearance of the building(s), the means of access thereto and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(3) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(4) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(5) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(6) A detailed scheme of boundary treatment shall be submitted for approval in writing by the Local Planning Authority and shall be implemented in its entirety before the first occupation of any of the residential accommodation hereby approved and thereafter maintained REASON: In the interests of visual and residential amenity.
REASON FOR DECISION: Outline planning permission is sought for residential development at Whitby Farmers, Liverton Mines, Loftus. The site is within the limits of development and a predominantly residential area and as such Policies GEN1, GEN2, LD1, H3 and T6 of the Local Plan provide the basis for determining this proposal. These policies seek to ensure a satisfactory design and layout of residential development that respects the character and appearance of the area; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The application site is located within a predominantly residential area where there is a mix of dwelling types and as such the principle of residential development is acceptable. The applicant has requested that all matters be reserved for future consideration and thus no details are available at this stage. With regard to local residential amenity; there are residential properties to the south, east and west of the site. Details of layout and design are reserved for future consideration. However, there is no doubt that the site would be capable of accommodating some form of residential development without detriment to local residential amenity. Members will note that Northumbrian Water have not raised any objections to the proposal; connection to the main drainage system should not therefore pose problems. The issues regarding the party wall and its maintenance are for the developer to resolve and not matters with which the planning system can become involved. With regard to highway matters; means of access is reserved for future consideration. Access is currently from Liverton Terrace and supports the use as an animal foodstuffs warehouse. There is no doubt therefore that this site is capable of supporting a residential use without detriment to highway safety. The use of the site for residential purposes does not raise concerns with regard to crime prevention.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1, H3 & T6 were relevant to this decision.
