# Condition Details
1 (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision.
3 REASON FOR DECISION: Permission is sought for single storey extensions on both the east and west sides of Tudor Garth, Upper Garth Gardens, Guisborough a detached two story dwelling located within an established residential area in Guisborough Conservation Area. It is considered that Policies GEN1, GEN2, H10, ENV1 and ENV4 provide the basis for determining this proposal. These policies seek to achieve development that preserves or enhances the special architectural or historic character of the conservation area; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. Both extensions are simply designed reflecting features such as the mock tudor panelling of the existing building. It would not compromise the appearance of the dwelling and would not have a harmful impact upon Guisborough Conservation Area. With regard to local residential amenity both extensions would be close to the site boundaries. The porch on the east side of the property would be set in from the boundary sufficient to accommodate the eaves overhang and foundations. The property to the east is set some 8 metres from the boundary with Tudor Garth. The modest size and design of the extension would be such that no harm to the living conditions of the occupiers of the adjacent property or surrounding properties is envisaged. The proposed new garage on the west side of the property is set in from the boundary by between approximately 0.15 metres and 0.35 metres. The nearest properties on Meadow Close are located some 8 metres from the boundary with Tudor Garth. There is a high boundary fence between the properties. The garage would have a height at eaves of approximately 2.3 metres with a monopitched roof sloping away from the boundary. No windows are proposed within the side elevation. Bearing this in mind it is not considered that planning permission should be withheld on residential amenity grounds. This application does not raise concerns with regard to highway safety or the crime prevention aims of the Local Plan.
