| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | REASON FOR DECISION:The proposal has arisen out of concern for security and personal safety in and around the grade II listed Parish Church and churchyard in Loftus Conservation area which has been subjected to anti-social behaviour and vandalism. The proposed gate and railings have been designed to be in keeping with the setting of the church building and the character of the conservation area, while the closing-up of the opening in the churchyard wall on the west boundary, is to be carried out in matching materials. The proposals are supported by the Crime Prevention Officer of Cleveland Police. In objecting to the proposal to close-up the gate in the west boundary, the Town Council commented that "the paths through the churchyard are in regular use by residents of Hall Grounds and that this gateway is often used by Churchgoers when the lower section of Water Lane is parked-up, for example by hearses or wedding cars. Councillors would propose that a lockable gate would improve security while maintaining access for bona fide users." I have some sympathy with the Town Council's views. However, the closing up of the west gate will remove a safety hazard. At present the pedestrian descends down a flight of steps from the elevated churchyard to emerge blindly and directly onto the carriageway of Water Lane - a road without any footpath. A lockable gate at this point would have to open onto the carriageway owing to the steps. Blocking up this access will remove a hazard for pedestrians and should cause no real hardship since the main entrance to the church and churchyard is only a few yards away at the north-west corner, next to the Town hall The Council's Public Rights of Way Officer has advised me that no footpaths in the churchyard are shown on the Definitive Map.
