(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) This permission relates only to the amended plan(s) received by the Local Planning Authority on 1 July 2004. REASON: For the avoidance of doubt.
(3) The ground and first floor window in the north western elevation of the development, and any subsequent replacement, shall be glazed throughout with obscure glass and thereafter retained to the satisfaction of the Local Planning Authority. REASON: To safeguard the living conditions of the occupants of adjacent residential properties.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision.
REASON FOR DECISION: Permission is sought to extend 19 Beverley Road, Nunthorpe a semi-detached two storey dwelling located within an established residential area. As such it is considered that Policies GEN1, GEN2 and H10 provide the basis for determining this proposal. These policies seek to achieve development that respects the character and appearance of the area; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The proposed extension would adjoin the north western elevation of 19 Beverley Road and would be no closer to the north western boundary than the existing garage. It would project forward of the existing front elevation but would, however, still be set back from the front elevation of 21 Beverley Road and a “terracing” effect would not result. It is simply designed and would not have a detrimental impact upon the character or visual amenity of the area. The proposed extension would be in close proximity to the north western boundary with 21 Beverley Road and would be no closer than the existing garage. The existing shared access would be maintained. There is a garage at 21 Beverley Road adjacent to the boundary with 19 Beverley Road. This garage has a rear window. 21 Beverley Road also has a kitchen door and first floor landing window within its south eastern elevation. The kitchen window at 21 Beverley Road is rearward facing. There will inevitably be increased overshadowing of 21 Beverley Road as a result of this proposal, however, it is not considered that this would be so great as to warrant a recommendation that planning permission be refused. With regard to potential loss of privacy; the small windows serving a utility room (at ground floor) and landing window (at first floor) may be required to be obscure glazed if Members are minded to grant planning permission. In relation to other nearby residential property it is considered that size, design and location of the development is such that no harm to the living conditions of the occupiers of other nearby residential properties is envisaged. Both a garage and vehicle hardstanding would remain at the property. No harm to highway safety is therefore envisaged. The application does not raise issues concerning crime prevention.
