| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) This permission relates only to the amended plan(s) and letter received by the Local Planning Authority on 27 May 2004 and 18 June 2004 respectively. REASON: For the avoidance of doubt. |
| 3 | REASON FOR DECISION:Permission is sought to extend 5 Ainsdale Close, New Marske a link detached two storey dwelling located on the north west corner of Ainsdale Close a residential cul-de-sac located within an established residential area. It is considered that Policies GEN1, GEN2 and H10 of the Local Plan provide the basis for determining this proposal. There policies seek to achieve development that respects the character and appearance of the area; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. 5 Ainsdale Close is a linked detached property where it is proposed to extend by means of a single storey front extension; a single storey rear extension and a first floor side extension above the existing garage and workshop. Both the single storey extension would have a simple design and both would have monopitched roofs. The first floor side extension would also have a simple design with the first floor being set back from the front face of the existing dwelling by approximately 1 metre and the ridge line of the extension being approximately 0.25 metre lower than the existing ridge line. It would therefore appear as a subordinate feature. It is considered that none of the extensions would compromise the character or appearance of the area. With regard to the impact upon local residential; the proposed single storey front extension due to its location and modest size would not compromise the living conditions of any of the nearby residential occupiers. The proposed single storey rear extension due to the change in levels (the land slopes from south to north) and the distance from 3 Ainsdale Close no harm to the living conditions of the occupiers of that property is envisaged. 7 Ainsdale Close has a single storey rear extension and due to the resulting relationship no harm to the living conditions of the occupiers of 7 Ainsdale Close is envisaged. Due to the distance from other nearby residential property no harm to residential amenity is envisage. The first floor side extension would be adjacent to the boundary with 7 Ainsdale Close with the garage of number 7 between the boundary and its side flank wall. Windows are proposed both front (bathroom) and rear (bedroom); none within the side elevation. Bearing in mind the relationship between the two properties no harm to the living conditions of the adjoining occupiers is envisaged. The applicants agent has confirmed no part of the development would encroach upon the adjoining property. The first floor extension would not result in any windows being closer to property at the front or rear and would be on the northside of the property and as such no harm to the living conditions of other neighbouring property is envisaged. Garage space and vehicle hardstanding would remain available for vehicle parking using the existing access. No harm to highway safety is envisaged. This application does not raise concerns regarding crime prevention. |
| 4 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision. |
